Additional Terms and Conditions for AI Services Sportjeal

These terms and conditions are in addition to the Terms & Conditions and the Privacy Policy van Sportjeal BV (hereinafter referred to as “Sportjeal”). By using the AI services of Sportjeal, you (hereinafter “User”) agree to these additional terms.

Article 1: Definitions

1. AI service: The door Sportjeal developed a chatbot and related artificial intelligence functionalities that support coaches in, among other things, designing training sessions and assessing players.
2. User: The trainer or other authorized person using the AI Service.
3. Input: Any data, queries, and commands entered by the User into the AI Service.
4. Output: Any content generated by the AI service, such as training schedules, analyses, and recommendations, based on User Input.

Article 2: Use and Purpose of the AI Service

1. The AI service is intended as a tool and source of inspiration for users. It is designed to assist with professional tasks, not replace them entirely.
2. The User is not permitted to use the AI Service for illegal purposes, to violate the rights of third parties, or in a manner that may harm the operation of the Service.
3. Sportjeal reserves the right to monitor the use of the AI Service and block access to a User in case of misuse.

Article 3: Responsibility and Professional Judgment

1. The Output of the AI Service is generated based on algorithms and data and may contain incompleteness or inaccuracies.
2. The User remains ultimately responsible for the use of the Output at all times. This includes, but is not limited to, the suitability, safety, and effectiveness of a training session or the accuracy of a player's assessment.
3. The use of the Output generated by the AI Service does not under any circumstances replace the User's professional judgment, knowledge and experience.

Article 4: Data, Privacy and Confidentiality

1. The processing of personal data via the Input is subject to the Privacy policy of Sportjeal.
2. The User warrants that he/she is entitled to process and share the provided Input, including any personal data of players, with the AI service. The User indemnifies Sportjeal for claims by third parties in this regard.
3. Sportjeal may use anonymized input and output to analyze, improve, and further develop the AI service. This data cannot be traced back to an individual user or player in any way.

Article 5: Intellectual Property

1. All intellectual property rights relating to the AI Service itself, including the underlying software and algorithms, belong to Sportjeal.
2. Subject to compliance with these terms and conditions, Sportjeal the User a non-exclusive, non-transferable right to use the generated Output for his/her own (commercial) purposes.
3. The User may freely use the Output, but cannot claim any intellectual property rights to the Output.

Article 6: Exclusion of Warranty and Liability

1. The AI Service is provided on an “as-is” basis, without warranties of any kind, either express or implied. Sportjeal does not guarantee that the service will be uninterrupted, error-free or completely accurate.
2. Sportjeal shall not be liable for any direct or indirect damages (including, but not limited to, injuries, disappointing results or business losses) arising from the use of, or inability to use, the AI Service and the generated Output.

Article 7: Amendment of the Terms and Conditions

1. Sportjeal reserves the right to change these terms and conditions at any time.
2. Users will be notified of material changes in a timely manner. Continued use of the AI Service after a change constitutes acceptance of the new terms.

Article 8: Declaration of Agreement

By logging in and using the AI service of Sportjeal, the User declares that he/she has read these additional conditions and unconditionally agrees with them.
